APMBuzz Facebook Monthly Integrity Sweepstakes – Official Rules
There is NO PURCHASE NECESSARY to enter or win. Void where prohibited by law.
1. Who is eligible?
The Sweepstakes is open only to legal residents of the United States, who are 18 years of age and older as of the date of entry. Void where prohibited by law. All federal, state and local laws and regulations apply.
2. Who is sponsoring the Sweepstakes?
The Sweepstakes is sponsored by Viceroy, Inc. (APM Corporate), 3225 Pasadena Blvd., Pasadena, TX 77503 (the “Sponsor”).
3. How do I enter?
There is NO PURCHASE NECESSARY to enter or win. The Sweepstakes runs from the time of the first monthly Integrity Post to the APMBuzz Facebook page through 11:59 p.m. (CST) on the last day of each month (the “Entry Period”). During the Entry Period, visit the APMBuzz Facebook page at https://www.facebook.com/APMBuzz. There may be up to two (2) Integrity Posts each month published to the APMBuzz Facebook page. During the Entry Period, there are three (3) ways to enter: Method 1: “Like” one or both of the Integrity Posts. Likes will receive one (1) entry in the Prize drawing. Method 2: “Share” one or both of the Integrity Posts to your own Facebook activity feed. Shares will receive two (2) equal entries in the Prize drawing. Method 3: “Comment” on one or both of the Integrity Posts. Comments will receive three (3) equal entries in the Prize drawing. Entrants may increase their chance of winning by participating in each Integrity Post using all three (3) methods of entry. All entrants are eligible to win one (1) time only. Winners from previous months are allowed to engage with the monthly Integrity Posts after distribution of the Prize, however their participation will no longer be considered entrance for the Sweepstakes.
4. How will a winner be selected?
On or about the day following the Entry Period each month, a representative from the Sponsor will select one (1) winner in a random drawing from the pool of entries. The odds of winning depend on the number of eligible entries received. The potential winner will be notified via Facebook Messenger within fifteen (15) days of the drawing. A potential winner may be required to provide or confirm a valid mailing address for the Prize within ten (10) days of the Prize notification via Facebook Messenger. If any Prize notification is undeliverable, a potential winner declines to accept the Prize, has violated any of these Official Rules or fails to provide a mailing address within the required time period, then an alternate entrant will be selected in his/her place in a random drawing of remaining entries.
5. What can I win?
The monthly winner will receive a Prize not to exceed the retail value of $25.00 (the “Prize”). Any Prize details not specified above will be determined by the Sponsor in its sole discretion. Prizes are not transferable and must be accepted as awarded. No cash or other substitution may be made, except by the Sponsor, who reserves the right to substitute a Prize with another Prize of similar value if the Prize is not available for any reason as determined by the Sponsor in its sole discretion. The winner is responsible for taxes and any and all other costs and expenses not listed above.
6. What other terms should I be aware of?
By participating in the Sweepstakes, entrants agree to be bound by these Official Rules and the determinations of Sponsor, which shall be final. Unless prohibited by law, entrants agree to allow use of their name, photograph, and/or likeness for advertising and/or trade and/or any other purpose in any media or format now or hereafter known without further compensation, permission or notification.
The Sweepstakes is subject to federal, state, and local laws and regulations and is void where prohibited by law. In the event that the operation, security, or administration of the Sweepstakes is impaired in any way for any reason, including, but not limited to fraud, virus or other technical problem, the Sponsor may, in its sole discretion, either: (a) suspend the Sweepstakes to address the impairment and then resume the Sweepstakes in a manner that best conforms to the spirit of these Official Rules; or (b) award the Prize at random from among the eligible entries received up to the time of the impairment. The Sponsor reserves the right in its sole discretion to disqualify any individual it finds to be tampering with the entry process or the operation of the Sweepstakes or to be acting in violation of these Official Rules or in an unsportsmanlike or disruptive manner. Any attempt by any person to undermine the legitimate operation of the Sweepstakes may be a violation of criminal and civil law, and, should such an attempt be made, the Sponsor reserves the right to seek damages from any such person to the fullest extent permitted by law. Failure by the Sponsor to enforce any term of these Official Rules shall not constitute a waiver of that provision. Sponsor reserves the right to modify or cancel this promotion at any time and, in the event of cancellation, substitute another in its place.
By participating in the Sweepstakes, entrants agree to release and hold harmless the Sponsor, its parent and related companies, and their respective officers, directors, employees, and agents (the “Released Parties”) from and against any claim or cause of action arising out of participation in the Sweepstakes or receipt or use of any Prize, including, but not limited to: (a) unauthorized human intervention in the Sweepstakes; (b) technical errors related to computers, servers, providers, or telephone or network lines; (c) errors in the administration of the Sweepstakes or the processing of entries; or (d) injury or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from entrant’s participation in the Sweepstakes or receipt or use of any Prize. Entrant further agrees that in any cause of action, the Released Parties’ liability will be limited to the cost of entering and participating in the Sweepstakes, and in no event shall the Released Parties be liable for attorney’s fees. Entrant waives the right to claim any damages whatsoever, including, but not limited to, punitive, consequential, direct, or indirect damages.
By participating in the Sweepstakes, entrant (a) acknowledgesthat entrant has read, complied, andwill complywith all therules, regulations, terms and conditions set forthin the Official Rules; that entrant has not perpetrated and will not perpetrate any fraud or deceptionin connection with the Sweepstakes and has not sought to influence the outcome of the Sweepstakes other than by participating as expressly permitted in the Official Rules; (b) acknowledges that no guarantees or warranties have been made by Sponsor with regard to the nature, condition, or type of Prize to be awarded; (c) agrees to accept the Prize as awarded; (d) agrees to be responsible for all federal, state, and local taxes associated with Prize acceptance; (e) declares that he/she;
1) is a legal resident of either the 50 United States;
2) was at least 18 years of age at the time of entry;
3) is subject to the terms of the Official Rules which shall apply to and be binding on entrant and entrant’s heirs, executors, administrations, personal representatives and assigns; and
4) warrants and represents that the terms of this document do not in any way conflict with any existing commitment on entrant’s part.
By participating in the Sweepstakes, entrantreleases, indemnifies and holds harmless Viceroy, Inc. (APM Corporate) ("Sponsor"); their respective parents, subsidiaries and affiliates and advertising and promotion agencies; the employees, officers, directors, representatives and agents of each of the foregoing; and the heirs, executors, administrators, persona l representatives, successors and assigns of the foregoing (collectively, "Releasees") from any claims, demands, payments, actions, or causes of action for damages, loss or injury, arising as a result of my participating in the Sweepstakes and accepting the Prize, which entrant or entrant’s heirs, executors, administrations, personal representatives or assigns may now or hereafter have against them. By participating in the Sweepstakes, entrant acknowledges this is a complete RELEASE and DISCHARGE of all claims and rights of the entrant against the Releasees, and that no action will be taken by or on behalf of the entrant with respect to any such rights; it being understood that this release shall be binding upon the parents, guardians, heirs, executors, and administrators of the entrant.
7. How will disputes be handled?
Except where prohibited by law, entrant agrees that any and all disputes, claims and causes of action arising out of, or connected with, the Sweepstakes or any Prize awarded shall be resolved individually, without resort to any form of class action, and exclusively in the U.S. District Court for the Southern District of Texas or in the appropriate state courts of Harris County, Texas. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, entrant’s rights and obligations or the rights and obligations of the Sponsor in connection with the Sweepstakes, shall be governed by, and construed in accordance with, the laws of the State of Texas, without giving effect to any choice of law or conflict of law rules (whether of the State of Texas or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the State of Texas.
8. How can I find out who won?
To obtain the name of the monthly winners, visit our APMBuzz Facebook page after the conclusion of the Entry Period each month. The winner will be named via a Facebook Post within fifteen (15) days of the distribution of the Prize.
